a. Original Artworks & Creative Collections
All original artworks, bespoke commissions, limited editions, wearable art collections, art scarves, ready-to-wear garments, accessories, textile patterns, prints, and creative concepts are based upon and derived from the original artworks and designs of Mariya Dykalo.
All artworks, images, limited-edition prints, textile patterns, design concepts, and creative content displayed on the Website remain the intellectual property of Mariya Dykalo Ltd unless otherwise stated and may not be copied, reproduced, distributed, adapted, or used without prior written permission.
Mariya Dykalo Ltd follows a limited-production, sustainability-focused approach. Many Items are produced in small quantities, made to order, or released as limited editions rather than as mass-produced collections.
Unless otherwise stated, available Items are typically dispatched within 2–4 working days.
Standard online boutique purchases of ready-to-wear garments, art scarves, wearable art accessories, and other eligible Items may be returned in accordance with our Returns Policy and applicable UK consumer law.

Resale Restrictions
You agree not to make the Wearable Art, Limited Edition Prints or Original Artworks available for resale for a period of two years without first offering them back to Mariya Dykalo Ltd at fair market value. Mariya Dykalo Ltd shall be entitled to rescind the sale of the Edition in the event of a breach of this clause.
b. Bespoke Commissions & Pre-Orders
If you require a custom artwork, commissioned piece, bespoke wearable art garment, alternative sizing, personalised design, or made-to-order Item, this will be treated as a bespoke commission or pre-order service.

A non-refundable deposit of 50% is required before work commences. Payment of the deposit confirms your approval for MD to begin creative development, source materials, reserve production time, and commence work on your commission.
The remaining balance must be paid in full prior to collection or dispatch.
As bespoke commissions and made-to-order Items are created specifically to your requirements, refunds, cancellations, or returns are not accepted once production has commenced, except where an Item is faulty or damaged.
We encourage clients to review all specifications carefully before confirming a commission.
5.1 Timing
Estimated completion and delivery dates are provided in good faith but are not guaranteed.
Commissioned artworks and bespoke Items may require varying production times depending on complexity, materials, and availability.
If your order is required for a specific event or deadline, we strongly recommend allowing sufficient time in case of unforeseen delays.
We are not responsible for delays caused by circumstances outside our reasonable control, including shipping delays, customs procedures, supplier delays, or missed communications.
5.2 Adjustments

International customers are responsible for any customs duties, import taxes, or local charges applicable in their country.

Original Artworks
Original artworks are sold as final sales and are non-refundable. If an artwork arrives damaged, please contact us promptly so we can assess the damage and, where appropriate, arrange restoration or repairs with the artist or a professional conservator.
Limited-Edition Prints
Limited-edition prints are sold as final sales and are non-refundable. If a print arrives damaged, please contact us. Once the damaged print has been returned, we will either provide a replacement or issue a credit note towards another print.
Online Boutique Purchases
For standard online boutique purchases, customers may request a return in accordance with applicable UK consumer law and our Returns Policy.

If you cancel a bespoke order after production has commenced, any deposit paid will be non-refundable, as materials will have been sourced and studio time incurred. Where substantial work has already been completed, we reserve the right to charge for work undertaken and materials purchased up to the date of cancellation.
If Mariya Dykalo Ltd cancels an order due to product unavailability, material sourcing difficulties, or other unforeseen circumstances, any payments received will be refunded in full within 14 days.
Nothing in these Terms affects your statutory rights under UK consumer law.

All original artworks, paintings, drawings, sketches, limited edition prints, wearable art, textile designs, prints, patterns, garments, accessories, photographs, website content, text, graphics, digital images, and all other creative works displayed on this Website are the intellectual property of Mariya Dykalo unless otherwise stated and are protected by UK and international copyright, design, trademark, and intellectual property laws.
The purchase of any artwork, limited edition print, wearable art piece, garment, accessory, or other Item does not transfer or assign any copyright, design rights, trademark rights, reproduction rights, or other intellectual property rights to the purchaser.
Copyright and all associated intellectual property rights remain exclusively with Mariya Dykalo.
The moral rights of the artist, Mariya Dykalo, are asserted at all times.
Without the prior written permission of Mariya Dykalo, you may not:
Collectors are welcome to photograph artworks that they own for personal and non-commercial purposes, provided that such use does not infringe the Artist’s copyright or suggest any commercial affiliation or endorsement.
Should you wish to reproduce an artwork for publication, editorial use, licensing, exhibition, or any commercial purpose, prior written permission must be obtained from Mariya Dykalo.
If you breach any of the intellectual property provisions contained within these Terms, Mariya Dykalo reserves the right to take any action considered necessary to protect her rights, including but not limited to:
Where an artwork, print, wearable art piece, or any image of such work has been reproduced, offered for sale, or otherwise used without permission, Mariya Dykalo may contact the relevant website operator, marketplace, auction platform, social media platform, or other third party and request the immediate removal of the infringing content.
Nothing in these Terms limits any statutory or common law rights available to Mariya Dykalo in respect of copyright, design rights, trademarks, passing off, or any other intellectual property rights.
Artificial Intelligence (AI) and Digital Use.
No artwork, image, photograph, design, textile pattern, wearable art, or other creative content belonging to Mariya Dykalo may be used for training, developing, testing, or operating artificial intelligence systems, machine learning models, image generation software, or similar technologies without the Artist’s prior written permission.
